The Site provides information about Promoting Image’s website design, search engine optimization, advertising, marketing automation, reporting, hosting, and consulting services, along with articles, case studies, and forms to contact us.
Client services are governed by a separate agreement
Information on the Site, including service descriptions, examples, and benchmarks, is not an offer or a contract. Any services we provide are governed by a written proposal, statement of work, or services agreement signed by you and Promoting Image. If those documents conflict with these Terms, the signed agreement controls.
No guarantee of results
Marketing results depend on many factors outside our control, including search engine and platform algorithms, competition, budgets, and your business operations. Case studies, examples, charts, and statistics on the Site illustrate past work or typical scenarios. Some charts are labeled as example data. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). This section does not limit liability under a signed services agreement, which is governed by that agreement.

You agree to indemnify and hold Promoting Image harmless from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or violation of these Terms.
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict of law rules. Any dispute related to the Site will be brought exclusively in the state or federal courts located in Nassau County, New York, and you consent to their jurisdiction.

We may update these Terms at any time by posting a new version on this page. The effective date shows when they were last changed. Continued use of the Site means you accept the updated Terms.
